PORTLAND, Ore. -- The parents of a 3-year-old boy who died after Dr. Jayant Patel operated on him in 1999 have agreed to settle a wrongful death lawsuit for $200,000.
The Multnomah County Circuit Court lawsuit filed by the parents of Ian McClellan contended Patel perforated the boy's bowel while attempting to place a feeding tube inside of him. The suit said the boy died of septic shock.
Patel was working for Kaiser Permanente, but performed the surgery at OHSU Doernbecher Children's Hospital. The boy's parents, Ana Maria and Matthew McClellan, filed suit against all three.
The family's lawyer says a confidentiality agreement prevents any comment. The Oregonian says it's not clear from court records what portion of the $200,000 will by paid by Patel, Kaiser or OHSU.
A judge is scheduled to approve the settlement today.
Patel has been reprimanded by medical boards in both New York state and Oregon. He has been charged with manslaughter in the deaths of three patients at a rural Australian hospital.
